1. Introduction

This page outlines the Terms of Service ("Terms") under which ChurchMost, LLC ("We", "Us", or "Our") provide Our software service and websites (collectively referred to as "ChurchMost").

Please read this page carefully before using ChurchMost as any User (described in more detail below). By using ChurchMost, ("You") are indicating acceptance to be bound by these Terms. These Terms are a binding contract between You and Us. If You are unwilling to be bound by these Terms, please do not use ChurchMost.

By entering into these Terms, You additionally acknowledge, understand, and accept Our Privacy Policy.

Please note that these Terms are subject to change. At any time, in Our sole disrection, We may revise the Terms by updating this page. You should revisit this page periodically to review the Terms of any or all changes as they are binding to You.

2. Customers, Users & Accounts

Various user accounts that are linked to a Customer Account ("Users") exist within ChurchMost. Below the various types of Users are described in more detail.

Customer & Initial User

The organization (in many cases, but not limited to, a church) is our customer ("Customer").

A ChurchMost account ("Account") may only be created on behalf of the Customer by an individual who is fully authorized to enter into binding contracts and conduct business on the Customer's behalf ("Initial User"). We may require proof of authority from the Initial User to enter into binding contracts on behalf of the Customer. Failure to provide such proof may result in the suspension of Customer access to the Account until proof is provided. We disclaim all liability for an Account that was opened by an individual who had no authority to do so on a Customer's behalf.

By creating an Account the Customer represents and warrants that the Initial User has full authority to create the Account and that all information submitted by the Initial User is truthful and accurate. The Customer also agrees to be responsible for keeping all Account information up to date with current information. Account information can be updated by an Admin User inside of the ChurchMost "Account Info" section by entering the new information and saving changes. Admin Users

Creation of Admin Users, Basic User (defined in more detail below) and full access to the Account is granted to Account level administrators ("Admin User"). On creation of the Account, the Initial User automatically becomes an Admin User.

Admin Users must also be fully authorized to enter into binding contracts and conduct business on the Customer's behalf. We may require proof of authority from the Admin User to enter into binding contracts on behalf of the Customer. Failure to provide such proof may result in the suspension of Customer access to the Account until proof is provided. We disclaim all liability for an Account that was opened by an individual who had no authority to do so on a Customer's behalf.

An Admin User may add or remove other Admin Users and Basic Users, as well as modify Account information, Account subscriptions, and Account billing and payment information. In the event that an Admin User is deleted the Admin User will no longer have access to the Account or any Account specific information inside of ChurchMost.

Admin Users may request termination of the Account on behalf of the Customer. Admin Users are not authorized to take action contrary to the Customer itself, the Customer's mission, or Customer instructions. We hold no liability for the actions or conduct of any Admin User or Customer including but not limited to deletion of data, improper use of data, inappropriate information posted, or violation of laws related to privacy.

In the event of conflict among Admin Users or Admin Users and the Customer, the Customer is responsible for resolving the conflict and provide Us with written instructions that are signed by the Chief Executive on how to proceed. We will proceed based on those instructions. In the event of a conflict over the identity of the Chief Executive, we will act in accordance to a court order that names the Chief Executive. If a dispute requires us to engage counsel, the Customer agrees to pay our fees and costs. During that time, the ChurchMost Account may be suspended until the conflict is resolved.

Basic Users

An Admin User may add additional users that are linked to the Account, but have restricted access to certain functionality inside of ChurchMost ("Basic User"). Basic Users do not have the ability to access or edit Account information, Account subscriptions, or Account billing and payment information.

Basic Users acknowledge and agree that Admin Users may alter or remove their access to the Account altogether. Furthermore, Basic Users agree that their user account may be deleted by an Admin User resulting in the loss of the Basic User's account related data.

All Users

All users agree that any data entered may be edit, deleted, or otherwise managed by any authorized and permitted User of the Account as long as said User possesses the proper user permissions or access level.

3. Congregants

Often times individuals will interact with ChurchMost providing their personal information in order to subscribe to alerts and updates from the Customer in the form of SMS text and/or email messages ("Congregant").

Congregants agree that the information they provide is their own or that they posses the required authority to subscribe the individual to alerts on their behalf. Congregants also agree that the information they provide is truthful and accurate.

Congregants additionally acknowledge that the information they provide will be stored in ChurchMost, linked to the Account, and made available to the Customer.

4. Responsibilities

Customer

The Customer shall ensure that itself and any associated Users comply with the Terms and Privacy Policy and is responsible for such compliance.

The Customer agrees to hold Us harmless for their conduct and the conduct of any associated Users per Section 14 (Indemnification).

Some features of ChurchMost allow Users to enter data into ChurchMost ("Customer Data"). Customer Data may include or incorporate information related to third party individuals ("Third-Party Information"). The Customer represents and warrants that it has the rights, basis, and permissions to enter the Customer Data and Third-Party Information into ChurchMost.

In the event that We are contacted by a person who has a dispute related to the Customer Data or Third-Party Information, We will notify the Customer within 45 days. We have the right to suspend or terminate the Account until the Customer and said person resolve their dispute. The Customer represents and warrants that it will hold Us harmless from all claims and/or disputes related to the Customer Data and Third-Party Information, as more fully described in Section 14 (Indemnification).

The Customer is responsible for complying with all applicable laws, rules and regulations, and represents and warrants that it and its Users will not use ChurchMost in a manner that violates the laws, rules and regulations in the applicable jurisdiction.

Users

Users shall follow the instructions of the Customer, and shall comply with the Customer's policies and practices that are relevant to the use of ChurchMost. Users shall also provide Us with all necessary rights, permissions and/or consents necessary to grant Us the rights and licenses in these Terms of Service, and all rights, permissions and/or consents necessary for the lawful use and transmission of personal information and data that is required for the use and operation of ChurchMost.

Admin Users shall ensure that Basic Users understand and comply with all of the Customer policies and practices that are relevant to the use of ChurchMost, understand and comply with these Terms and our Privacy Policy, and obtain all rights, permissions and/or consents from Basic Users that are necessary to grant Us the rights and licenses in these Terms as well as the lawful use and transmission of their personal information and data that is required for their use and operation of ChurchMost.

Everyone

All Customers and Users are responsible for their respective emails, passwords, and security of the Account. You are never allowed to use another's email and password or give others access to ChurchMost via your unique email and password.

You agree to notify Us immediately of any breach of security or unauthorized use of Your account. You acknowledge and agree that We will not be liable for any losses caused by any unauthorized use of Your email and password. You shall keep Your account password secure, and take appropriate measures to safeguard the security of Your email, password and electronic device(s).

All Users are responsible for keeping their information updated in the event that any changes occur. Users can update their information in the "My Info" section of their account settings by changing the pertinent information and saving the changes. If a User has questions or issues updating their information they can Contact Us.

Users of ChurchMost shall be responsible for complying with these Terms, and further understand and agree that they are responsible for all information, data and content that they enter into ChurchMost, and all activity that occurs using ChurchMost.

5. Usage Requirements

Use of Services

In Your use of ChurchMost, you represent, warrant and agree that you will not use (or plan, encourage or help others to use) ChurchMost for anything other than the Acceptable Uses, which are defined below in Section 5. You shall NOT use ChurchMost in any manner that is prohibited by these Terms or which is illegal or prohibited by applicable law (including but not limited to copyright laws).

Jurisdiction Compliance

You agree to comply with all local laws and rules regarding online conduct and acceptable data. Specifically, You agree to comply with all applicable laws of Your jurisdiction regarding the transmission of technical data and personally identifiable information exported from the United States or the country in which you reside.

Must be over age 13

You must be at least the age of 13 to use ChurchMost. If You are between 13 and the age of legal consent, an Admin User must secure and verify the consent of a parent or guardian who agrees to be bound to these terms to use or access ChurchMost. You may not use or access ChurchMost if You are under the age of 13.

Any use or access to ChurchMost by anyone under the age of 13 is strictly prohibited and in violation of these Terms. By using ChurchMost, You represent and warrant that You are over the age of 13 and You have (or, if You are between the age of 13 and legal consent, Your parent or guardian represent has) the full right, power and authority to enter into these Terms and to fully perform all of Your obligations hereunder. You further represent and warrant that You are under no legal disability or contractual restriction that prevents You from entering into these Terms. The Customer represents and warrants that the Customer is fully responsible for making sure it and its Users comply with this paragraph and the Terms.

Not previously prohibited

You may not use ChurchMost if You were previously prohibited from doing so by Us.

Be a human

Accounts registered by “bots” or other automated methods are not permitted.

Only 1 free trial

Individuals and organizations are not permitted to start or operate more than one (1) free trial.

6. Acceptable Use

We are providing ChurchMost to allow churches and organizations a way to communicate with their communities ("Intended Purpose"). You agree that You will only use ChurchMost for the Intended Purpose. You specifically agree that You will NOT:

  • Use ChurchMost if you are under the age of 13.
  • Use ChurchMost to upload, post, email, otherwise transmit, or post links to any content or information that exploits the images of children under 18 years of age, or that discloses personally identifying information belonging to children under 18 years of age without parental consent.
  • Use the Services to “stalk” or otherwise harass another.
  • Use ChurchMost to impersonate any person or entity, including, but not limited to, falsely state or otherwise misrepresent Your affiliation with a person or entity.
  • When signing up for ChurchMost, use misleading email address or enter false and/or misleading information into ChurchMost regarding the Customer.
  • Use the Service to upload, post, email, otherwise transmit, or post links to any content or information that You do not have a right to transmit under any law or regulation or under contractual or fiduciary relationships (such as inside information, or proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements).
  • Use ChurchMost to upload, post, email, or otherwise transmit, or post links to any content or information that facilitates hacking.
  • Use ChurchMost to upload, post, email, otherwise transmit, or post links to any content or information that infringes any patent, trademark, service mark, trade secret, copyright or other proprietary rights of any party, or contributing to inducing or facilitating such infringement.
  • Use ChurchMost to upload, post, email, otherwise transmit, or post links to any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation.
  • Use ChurchMost to upload, post, email, otherwise transmit, or post links to any material that contains software viruses, worms, Trojan horses, time bombs, trap doors or any other computer code, files or programs or repetitive requests for information designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment or to diminish the quality of, interfere with the performance of, or impair the functionality of the Services.
  • Use automated means, including spiders, robots, crawlers, or the like to download data from any of our databases, unless said means is by an API that we have specifically approved of.
  • Conduct Your own contests and promotions using the Services or use ChurchMost to upload, post, email, otherwise transmit, or post links to any information regarding any raffle, contest or game requiring a fee by participants.
  • Incorporate information or content from our Services into any email or “white pages” products or services, whether browser-based, based on proprietary client-site applications, web-bates or otherwise.
  • Sell, distribute or make any commercial use of Third-Party Information in a manner that could be expected to offend the person for whom the Third-Party Information is relevant.
  • Engage in any of the following prohibited activities: copying, distributing, or disclosing any part of the Services in any medium, including without limitation by any automated or non-automated “scraping”; using any automated system, including without limitation “robots,” “spiders,” “offline readers,” etc., to access ChurchMost in a manner that sends more request messages to our servers than a human can reasonably produce in the same period of time by using a conventional web browser, unless said system is by an API that is specifically approved of by us.
  • Interfere with or disrupt ChurchMost or servers or networks connected to ChurchMost.
  • Decompile, disassemble, modify, translate, adapt, reverse engineer, create derivative works from, or sublicense any work, including but not limited to software which is deployed in connection with the Services.
  • Upload, post, email, otherwise transmit, or post links to any material, or act in any manner that is offensive or contrary to the spirit of these Terms.

7. Monitoring, Security, and Payment Processing

Monitoring

We have no obligation to monitor ChurchMost or Your use of ChurchMost. You acknowledge and agree that We have the right to monitor ChurchMost electronically from time to time and to disclose any information that we deem necessary to satisfy any law, regulation or other governmental request, to operate ChurchMost properly, or to protect itself or its users, affiliates, partners and contracted parties, as discussed in further detail in our Privacy Policy.

Security

Despite security being an import part of ChurchMost and what We do, We cannot ensure or guarantee the security of ChurchMost. Any such use shall be at Your sole risk, and You shall relieve Us and Our affiliates of all liability in connection therewith.

Payment Processing

We use Stripe, a third party, to process payments related to ChurchMost. Therefore, You may be asked by the third party payment processor to supply certain information, including credit card or other payment mechanisms. You agree that all information you provide any third party payment processor through ChurchMost will be accurate and complete. You agree to pay all charges incurred by You at the prices in effect when such charges are incurred. We are in no way responsible for any charges You or (if you are a Customer) any Users incurs when making purchases or other transactions. We may retain sufficient personal information from Your purchase to report to the IRS or other government authority, and retain such information for at least the minimum statutory period.

8. Billing, Payments, and Text Credits

Billing

ChurchMost Services are billed on a recurring monthly or recurring annual basis ("Billing Interval").

If You sign up for ChurchMost You will be billed immediately if you do not elect for a free trial and those whom elect for a free trial will be billed after their trial ends (see more below). All Accounts (including those who do and do not elect for a free trial) will be charged each month on the day they started their current billing cycle. For example, if You start your billing cycle on the second day of the month, You will always be billed on the second day of the month. If a month does not have Your billing day, You will be billed on the last day of the billing month. If You were to cancel or pause Your Account and then restart or resume Your Account with Us, Your billing day would then be that of the newest billing cycle.

Free Trial

If You sign up and elect for a free trial You will be granted 15 days of access to ChurchMost, 1 toll-free phone number, 250 text credits, and unlimited access to the Service. At the end of Your 15 days You will be automatically billed within 15 minutes after Your trial ends. If You cancel the Account before Your free trial period ends You will not be charged.

Renewals

At the end of Your free trial or current billing cycle, Your Account will be automatically renewed for an additional period. For example, if Your Account is set up for monthly billing You will be charged and renewed for another month of service. If Your Account is set up for annual billing You will be charged for another year of service. These aforementioned renewals will continue until Your Account is paused or canceled.

Overage Fees

ChurchMost text feature allows for the sending of SMS text messages. Accounts are alloted a number of credits they can use in a given month for a given billing period. Regardless of the Billing Interval, the Account will receive their text credits on a monthly basis and be evaluated for overage based on the monthly usage. Each message sent containing up to 160 characters will constitute as one (1) credit consumed per recipient. Messages larger than 160 characters will be split into 153 character "sections" where each section is constituted as one (1) credit consumed, per recipient. In the event You consume more text credits in a given billing period than Your plan allows, You will be charged per consumed credit over your alloted amount. The rate charged for overage credits is outlined in the pricing details for your Account's plan. Credit overages will be evaluated from the last billing period, to the current billing renewal time which shall also include the time it takes to process the plan renewal (roughly 15 minutes).

Credit Renewals

Account text credits are renewed at the start of a new billing cycle after any invoices and overage payments (if applicable) have been paid. Credit renewals can take up to 15 minutes to process once a new billing cycle begins.

Payments

Payments are processed through Stripe. You agree to pay the the amount charged for the paid account plan that You selected. You are also responsible for paying any sales and use taxes that may apply to Your purchase of the paid Account. If You do not pay on time or if Your payment method cannot be charged for any reason, We reserve the right to either suspend or terminate Your access to ChurchMost. We will not be responsible for any costs, expenses, or liabilities arising out of or related to the cancellation of Your Services for this reason. Our third party payment service provider (Stripe) may receive updated payment/banking information from Your credit card or payment method issuer. The disbursement of this updated information is provided at the election of Your credit card and payment method issuer. Neither we nor Our third party payment service provider is responsible for the distribution of Your credit card or payment method information. It is at the sole election of Your credit card or payment method issuer. Your credit card or payment method issuer may give You the right to opt out of the update service. It is Your responsibility to contact Your credit card or payment method issuer with regards to Your right to opt out of the update service.

Upgrades

When You upgrade Your subscription level, the new features will be available to You immediately upon upgrade and You will be charged for the remaining amount due immediately.

Non-Refundable

ChurchMost is billed in advance on a monthly or annual basis and is non-refundable. There will be no refunds or credits for partial months or years of service, upgrade/downgrade refunds, or refunds for unused months or years of ChurchMost. In order to treat everyone equally, no exceptions will be made.

Taxes

All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties, excluding only United States (federal or state) taxes.

Downgrades

For any upgrade or downgrade in plan level, the credit card that You provided will automatically be charged the new rate on your next billing period. Downgrading your Services may cause the loss of content, information, features, or capacity of your Account. We shall not be liable for any such loss.

Expired Credit Cards

In the event Your credit card expires or cannot be charged, we must suspend ChurchMost until You remit payment. You have 21 days to remit payment to Us before We terminate your Account and Your access to ChurchMost pursuant to Our termination provision below. We will not be responsible for any costs, expenses, or liabilities arising out of or related to the termination of Your Account.

9. Cancelation and Termination

The Customer is soley responsible for canceling the Account. An email or phone request to cancel your Account is not considered cancellation. To cancel the Account, an Admin User must go to the "Billing Info" section of the Account settings and click the cancel button. If You need help canceling Your Account Contact Us. Be aware that You will no longer have access to ChurchMost after cancelation.

We, in Our sole discretion, have the right to suspend or terminate Your Account and refuse any and all current or future use of ChurchMost for any reason at any time, including a violation of these Terms. In addition, in the event You fail to remit payment for ChurchMost, we shall suspend Your Account. After 21 days of suspension or 14 days in the event of cancelation, the Account may lose previously held phone numbers or linked social account connections as well as other data inside ChurchMost. We will not be responsible for any costs, expenses, or liabilities arising out of or related to the cancelation of Your Account.

If Your Account is cancelled or suspended before the end of the billing period that is currently paid for, Your cancellation/suspension will take effect immediately and You will not be charged again. However, we do not offer refunds if Your Account is canceled or suspended before the end of the billing period.

10. Price Changes

We reserve the right to modify or discontinue, temporarily or permanently, ChurchMost (or any part thereof), with or without notice.

Though We aim to honor "grandfathered" pricing of existing Customers, prices for ChurchMost, including but not limited to monthly and annual subscription fees to ChurchMost, are subject to change upon 30 days notice from us. Such notice may be provided at any time by posting the changes to our website (https://churchmost.com) and by emailing the Customer to the Admin Users’ email addresses provided through ChurchMost. The Customer agrees to receive such emails regarding pricing changes. We shall not be liable to You or to any third party for any modification, price change, suspension or discontinuance of ChurchMost.

11. Messaging Services

SMS Text Messaging

ChurchMost has features that use text messages in the United States. Individuals who have opted into receiving messages from these services are called “Subscribers”.

Credits for text messaging services may only be used by the Account. The credits cannot be transferred, sold, or gifted to other Customers. Credits will expire at the end of each billing cycle, or at the end of each monthly interval of an annual plan for Accounts that choose an annual Billing Interval.

Standard message and data rates may apply for any messages sent to or from the Subscribers. Message frequency varies. Carriers are not liable for delayed or undelivered messages.

Subscribers can always opt out of receiving additional messages at any time by using the reserved term “Stop”. We will send one additional message to confirm the Subscriber has been unsubscribed. After this, the Subscriber will no longer receive SMS messages from ChurchMost for the given keyword.

Subscribers can access customer support by texting the reserved term "Help" or by Contacting Us.

Email Newsletters

ChurchMost has features that allow the sending of email newsletters. Recipients of said email newsletters may Unsubscribe at any time by clicking the "Unsubscribe" link in the email footer. Unsubscribing will remove the recipient from the email list associated with the email.

Consent & Abuse

Accounts are to ensure that all text and email recipients, sent to by means of a text keyword or email list inside of ChurchMost, have the necessary consent to contact said individual via the contact method used. Customers are soley responsible for Users compliance of subscriber consent.

12. Intellectual Property Rights & Content Ownership

Our Intellectual Property

ChurchMost, including but not limited to text, graphics, images, logos, buttons, icons, software and other materials and the overall "look" and "feel" of ChurchMost, are the sole property of Us, and are the protected patents, copyrights, trademarks, and service marks of ChurchMost (the “ChurchMost IP”). Content which is not created by us, including all other third-party product and service marks, are the trademarks and copyrights of their respective owners. Unauthorized use of the ChurchMost IP may violate copyright, trademark and other laws. You may not reproduce, modify, display, sell, or distribute the ChurchMost IP unless you obtain our explicit written consent. We grant you a license to use the ChurchMost IP for the sole purpose of accessing and using ChurchMost.

Your Intellectual Property

We claim no intellectual property rights over the Customer Data – the Customer Data remains Yours. However, We ask that You respect the law, and not violate anyone's intellectual property rights. Thus, You represent and warrant that:

  • The Customer Data does not and will not violate third-party rights of any kind, including without limitation third-party copyrights, trademarks, or rights of privacy or publicity.

  • The Customer Data does not violate these Terms, and falls within the Acceptable Uses section of these Terms.

  • There is no suit action or claim or other legal or administrative proceeding now pending or threatened which might directly or indirectly affect any of the Customer Data, or which might in any way impair the rights granted by You under these Terms.

  • You own all right, title and interest in the Customer Data, or, If the Customer Data incorporates content/information created by another individual/entity or content/information from and/or about another individual/entity (collectively, "Additional Content"), you represent and warrant that You have all rights, licenses and applicable permissions required by law to post and use the Additional Content.

Other's Content

You shall not post or use any information or content that is not Yours without the appropriate permissions. Specifically, if You post, use, submit or share Additional Content, you represent and warrant that You have all rights, licenses and applicable permissions required by law to post and use the Additional Content. As such, You shall hold Us harmless from all claims and/or disputes related to the Additional Content per Section 14 (Indemnification).

Licenses

You expressly grant us, and you represent and warrant that You have all rights necessary to grant to Us, a worldwide, non-exclusive, sublicensable, transferable, perpetual and irrevocable license to use the Customer Data to provide ChurchMost.

Third Parties' Intellectual Property

We use several third-parties to make certain features of ChurchMost available to You, including but not limited to Facebook, Instagram, and Twitter. You agree to be bound by these third party licenses of software or content, and You further agree to abide by the terms of use and privacy policies of any such third party software or content.

13. Indemnification

You agree to defend, indemnify and hold harmless ChurchMost, LLC and its employees, officers, directors and agents from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from: your breach of these Terms of Service, your breach of representations and warranties made in these Terms of Service, your violation of any other person's intellectual property, your conduct (including but not limited to violations of the law), and your use of ChurchMost. The Customer specifically agrees to defend, indemnify and hold harmless ChurchMost, LLC and its employees, officers and directors from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from the actions or inactions of the Customer and its Users. The Customer also understands and agrees that it shall bear all responsibility for the Customer Data and Third-Party Information, and that the Customer shall resolve all disputes involving the Third-Party Information.

14. Disclaimers and Warranties

Release and Limitations of Liability

You agree to release ChurchMost, LLC. and Our employees, directors and officers from any claims, demands and damages (actual, consequential, direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with these Terms and/or Your use of ChurchMost.

IN NO EVENT SHALL WE BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, INCOME, OR DAMAGES RESULTING FROM LOST DATA, INACCURATE INFORMATION, OR BUSINESS INTERRUPTION) AND THE USE OR ACCESS TO, OR THE INABILITY TO USE OR ACCESS, CHURCHMOST AND/OR THE CONTENT WITHIN CHURCHMOST, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE ARE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. By entering into these Terms You acknowledge and agree that We are simply providing ChurchMost for free, or at times for a fee, and that We make no warranties of any kind relating to ChurchMost, any data or content contained within or related to ChurchMost, any data or content available through ChurchMost, and documents or information available through ChurchMost. Furthermore, nothing on or within ChurchMost shall be considered an endorsement, representation, assumption of, responsibility or warranty with respect to any third party, whether in regards to their website, products, technologies, services, business practices or otherwise.

WE DO NOT WARRANT THAT CHURCHMOST, OR THE CONTENT AVAILABLE ON OR THROUGH CHURCHMOST, WILL MEET YOUR EXPECTATIONS, OPERATE ERROR-FREE, OR BE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS. WE MAKE NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF CHURCHMOST, SOFTWARE, TEXT, GRAPHICS AND LINKS.

Limitation of Actions

You acknowledge and agree that, regardless of any statute or law to the contrary, any claim or cause of action You may have arising out of, or relating to, Your use of ChurchMost must be filed within one (1) year after such claim or cause of action arises, or forever be barred.

Accessing outside of the United States

We make no claims that ChurchMost is appropriate or legal to be viewed by certain persons or in certain countries. If you access ChurchMost from outside of the United States, You do so at Your own risk and are responsible for compliance with the laws of Your jurisdiction.

No waiver and partial validity

The failure of ChurchMost to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision. The Terms constitutes the entire agreement between you and ChurchMost, LLC and governs your use of ChurchMost, superseding any prior agreements between You and Us (including, but not limited to, any prior versions of the Terms). If any provision of these Terms is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of the Terms, which shall remain in full force and effect. No waiver of any term of the Terms shall be deemed a further or continuing waiver of such term or any other term.

Equitable Relief

You understand and agree that due to the nature of these Terms, in addition to money damages, We will be entitled to equitable relief upon a breach of the Terms by You.

These terms constitute Our entire binding Terms, and supersede any and all prior understanding, statements or representations, whether electronic, oral or written, regarding ChurchMost, LLC’s Services.

Digital Admissibility

You hereby agree that a printed version of these Terms shall be admissible in judicial or administrative proceedings and is subject to the same conditions as other agreements, business documents or records originally generated, entered into, signed or maintained in printed form.
